NOTICE OF REFERENDUM
TO BE HELD IN
THE TOWN OF COTTAGEVILLE, SOUTH CAROLINA

     NOTICE IS HEREBY GIVEN that the questions set forth below will be submitted to all persons qualified to vote in the Town of Cottageville, South Carolina (the “Town”), under the Constitution and laws of the State of South Carolina, at a referendum to be held in the Town of Cottageville on November 4, 2008 to wit:

Shall the Town Council be empowered to acquire by initial construction or purchase and thereafter operate a Water System and Wastewater/Sewer System to furnish Water Service and Wastewater/Sewer Service to individuals, firms and private and public entities?

The question is being submitted at the request of the Town Council of the Town of Cottageville, South Carolina pursuant to Article VIII, Section 16 of the Constitution of the State of South Carolina.

Shall the Town Council of the Town of Cottageville be empowered to issue general obligation bonds of the Town of Cottageville in an amount of up to Twelve Million Five Hundred Thousand Dollars ($12,500,000.00) for the purpose of acquiring by initial construction or purchase and thereafter operate a Water System and Wastewater/Sewer System to furnish Water Service and Wastewater/Sewer Service to individuals, firms and private and public entities?

The question is being submitted at the request of the Town Council of the Town of Cottageville, South Carolina pursuant to Article X, Section 14 of the Constitution of the State of South Carolina, Section 11-27-40 of the Code of Laws of South Carolina 1976, as amended and the South Carolina Municipal Bond Act.

If a majority of the qualified electors of the town voting in the referendum approve the issuance of up to Twelve Million Five Hundred Thousand Dollars ($12,500,000.00) general obligation bonds, the bonds may be issued by the Town either as a single issue or from time to time as several separate issues.  The proceeds of these bonds will be used for the purpose of paying the costs of to acquire by initial construction or purchase and thereafter operate a Water System and Wastewater/Sewer System to furnish Water Service and Wastewater/Sewer Service to individuals, firms, and private and public entities.

     The wards and precincts and locations of the several voting places at which the question will be submitted shall be as follows:

     The polls shall be opened at seven o’clock in the forenoon and closed at seven o’clock in the afternoon on the date fixed for the referendum.  Appropriate boxes or voting machines shall be provided at the voting places for the casting of ballots on the questions.  Managers of Election will be appointed by the Colleton County Election Commission for the Town of Cottageville.

     Every person offering to vote must be at least 18 years of age and must be duly registered on the books of registration for the Town of Cottageville, South Carolina as an elector in the precinct or ward in which he or she resides and offers to vote on or before the date on which the books of registration are closed for the referendum, and must present his or her registration certificate or valid South Carolina driver’s license or other form of identification containing a photograph issued by the South Carolina Department of Highways and Public Transportation, if not licensed to drive.  Any registered elector who has moved his or her place of residence within the Town of Cottageville after the date in which the books of registration are closed for the referendum, but before the date of the referendum, shall be entitled to vote in his previous precinct of residence in the referendum.

     The last day on which persons may register in order to be eligible to vote in the referendum will be October 4, 2008.  Applications for registration to vote sent by mail must be mailed or delivered to the Colleton County Election Commission for the Town of Cottageville on or before October 4, 2008.  The process of examining the return-addressed envelopes containing absentee ballots will begin at 9:00 a.m. on November 4, 2008.

     A hearing on ballots challenged, if any, in the referendum will be held at the time and place set by the Colleton County Election Commission in the Town of Cottageville.
